• WHO IS THE DATA CONTROLLER? HAS A PERSONAL DATA PROTECTION OFFICER (DPO) BEEN APPOINTED?

  The Data that you will provide us will be processed for the purposes indicated in the paragraph “For what purposes do we process your Data and what are the legal basis?”. With regard to the purposes of processing “Purchase of products and related activities”, “Loyalty Program Management”, “Personalized assisted sale”, “Direct marketing”, “Profiling” e “Statistical analysis”, the Data Controllers (that jointly determine the purposes and means of processing as Joint Controllers) are:
  

  • Calzedonia S.p.A. (hereinafter even only “Calzedonia”), with legal seat in via Portici Umberto Primo 5/3 Malcesine (Verona, Italy) and headquarter in Via Monte Baldo n. 20, Dossobuono di Villafranca (Verona, Italia);
  • Falconeri S.r.l. (hereinafter even only “Falconeri”), with legal seat in via del Lavoro n. 18, Avio (Trento, Italy).

  For all the other purposes indicated hereinafter, the only Data Controller is Falconeri, that you may contact by writing to privacy@oniverse.it
  

  The Data Protection Officer appointed by Calzedonia and Falconeri, in charge with the supervising of the compliance with the legislation on the protection of personal data and acting as a contact point for requests from the subjects to whom the personal data refer to, may be contacted by writing to dpo@oniverse.it

• WHAT CATEGORIES OF PERSONAL DATA DO WE PROCESS?

  To let you have access to the contents and services available in our website, we may ask you:
  • contact details collected through our online forms;
  • if you have received a Gift Card as a gift, to be able to deliver it and allow you to use it, we will use your contact details (your name and your e-mail address). These data are communicated to us by the purchaser of the Gift Card at the time of purchase;
  • with reference to the management of purchasing processes and related activities, we will process the contact details (name, surname, e-mail address) and the shipping address that you will indicate to us. This information is necessary to be able to deliver the order placed, allow the shipment to be monitored, certify the delivery of the goods and possibly proceed with the activation of the return and refund process for you. In the latter case, we may also collect the IBAN code.
  We do not process the data relating to the payment method indicated by you (e.g. payment card number and security code), which are instead collected exclusively by the chosen payment service provider.
  The data essential for the use of our services are marked with an asterisk: failing to provide this information, we will therefore not be able to make the products and services you requested available to you.
  For profiling and/or statistical analysis purposes, we may also collect the information obtained by examining your interaction with us, through e-mails, our website and through the Apps that may be developed by us or by third parties (for more information, we invite you to consult the relative privacy policies).
  We will process the personal data that you provide us with only for the relative purpose and strictly in connection with the relevant service requested and used.
  We may use your data for further or different purposes, only with your consent or, in certain limited cases, in the presence of our legitimate interest.
  We will never ask you for data of a sensitive (relating to revealing racial and ethnic origin, religious, philosophical, political beliefs, state of health, sexual life, etc.) or judicial (data relating to criminal records, or relating to the status of accused or suspected, etc.) nature.

• Social Network

  On our website you can also find social buttons/widgets, depicting the icons of social networks (e.g., Facebook, Google and Twitter) and interactive social walls (that show pictures coming from social networks). These "buttons" allow users who are browsing the website to interact directly with the social network which acquires data relating to your visit.
  In some areas of the website, you may also find the so-called social login, that allows you to login your reserved area through the social network account. When you use the social login, you accept the terms and conditions and the privacy policy of the social network itself.
  

• FOR WHAT PURPOSES DO WE PROCESS YOUR DATA AND WHAT ARE THE LEGAL BASIS?

  PROCESSING	PURPOSE	LEGAL BASIS
  Browsing	While you visit our site, the computer systems used to operate them acquire some data (e.g. IP addresses, domain names, URIs) whose transmission is implicit and necessary for the Internet to function. Calzedonia uses this data for the sole purpose of allowing users to browse and obtain anonymous statistical information on the use of the sites and to check their correct functioning or to ascertain responsibility in the event of IT crimes.	The need to allow users to browse the sites. Falconeri's legitimate interest in ensuring the proper functioning of IT systems and in proceeding with the investigation of alleged IT crimes (also on the basis of the existence of a legal obligation).
  Purchase of products and related activities	Data collected will be used for the fulfilment of purchase orders and for related activities (sending of goods, invoicing, payment management, delivery of goods, order refund, return management, etc.).	Execution of the contract of sale of products.
  Customer Care	We provide you with an assistance service (via chat, telephone, email, online form) for all your needs related to the purchase of our products or the use of our services. In some cases, we may ask you for your personal data when this is necessary to respond to the requests you make to our Customer Care.	Execution of the contract for the sale of products or of pre-contractual measures adopted based on your request. To use the chat support service, we will ask you to provide your name and email address: these data are required based on our legitimate interest in preventing the so-called "Chat spam".
  Loyalty Program Management	Manage participation in the loyalty program in order to provide members with discounts and other benefits provided in their favour and, more generally, for all related contractual and administrative obligations.	Execution of the contract of enrolment in the loyalty program (Falconeri Club Loyalty Program Regulation).
  Direct marketing	Sending commercial communications through the traditional paper mail service, email, SMS, landline and mobile phone; carrying out market research and surveying your degree of satisfaction regarding products relating to all the brands of the Calzedonia Group (Calzedonia, Intimissimi, Tezenis, Falconeri, Signorvino).	Your consent, that you may revoke at any time by writing to privacy@oniverse.it or by logging in in your reserved area.
  Profiling	We will use data relating to your purchases, your online behaviours, your country of origin, your gender and your age to send you profiled commercial communications. Profiling allows us to send you personalized communications based on your profile and habits and to develop products and services consistent with the preferences of our customers. To better understand your tastes and interest in our products and our communications, we may also use automated systems that do not, in any case, entail legal effects or other significant effects for the customer.	Your consent, that you may revoke at any time by writing to privacy@oniverse.it or by logging in in your reserved area.
  Personalized assisted sales (only for members of the loyalty program)	To provide a personalized assisted sales service: customers enrolled in the loyalty program will be able to take advantage of the help and personalized advice of our sales assistants based on information (e.g. size, colour, model) relating to purchases made in the previous 12 months.	Calzedonia and Falconeri’s legitimate interest in providing the best customer assistance service to customers enrolled in the loyalty program in its stores, in line with their needs.
  Anti-fraud	In relation to the purchase of products, verification of the correspondence between the buyer and the holder of the selected payment method.	Falconeri's legitimate interest to prevent and combat fraud.
  Events’ participation	We will use your data to allow you to make reservations for our events	The legitimate interest of Falconeri consisting in the need to organize and manage the conduct of its promotional events.
  Registration in the reserved area	Creation of a reserved area that will allow you to save some content (e.g., the "wishlist" i.e., the list of your favourite products, your purchase history, etc.).	Execution of the contract of registration on the website.
  Gift Card	We will process the name and e-mail address of the recipient of the Gift Card (i.e., the person who will receive it as a gift) as they are the contact details necessary to deliver the Gift Card and to ensure its use.	Falconeri’s legitimate interest in guaranteeing the delivery and use of the Gift Card to the recipient of it.
  Statistical analysis	We create statistical reports and behavioural models in order to examine - in aggregate form - the effectiveness from an economic point of view of Calzedonia's commercial initiatives (for example the interest in a new product) and to guide our future commercial and promotional initiatives.	Calzedonia and Falconeri's legitimate interest in analysing - in pseudonymized form (therefore without information directly attributable to individual customers) - customer data to obtain strategic information relating to: customer purchasing behaviour, the ways in which customers interact with the company through the various communication channels and the effectiveness of commercial and promotional initiatives, to be able to compete with the main operators in the sector.
  Share your wishlist	We will process the name and e-mail address of the person with whom the wishlist is shared.	Falconeri’s legitimate interest in assuring the functioning of the “Share your wishlist” service.

  
  

• HOW LONG DO WE KEEP YOUR PERSONAL DATA?

  PROCESSING	RETENTION PERIOD
  Browsing	Thirty days, unless legal provisions or provisions of Public Authorities impose a different retention time in relation to investigations related to any IT crimes.
  Purchasing of products and related activities	Time necessary to fulfill the contractual obligations and obligations imposed by law (e.g., tax law).
  Customer Care	Time strictly necessary to satisfy your request
  Loyalty Program	The duration of your participation in the loyalty program. In any case, the information relating to your purchases with us will be retain no later than 12 months from the date of collection.
  Direct Marketing	Until you revoke your consent
  Profiling	12 months from the date of collection. The information relating to your purchases will be kept for 3 years from the date of each purchase.
  Personalized assisted sales (only for members of the loyalty program)	12 months from the date of collection.
  Anti-fraud	Two years.
  Event’s participation	For each event we will provide you with a specific policy that will detail the storage duration for the participation in events and initiative.
  Registration in the reserved area	If the account is not used for more than three years, we will delete it and the data relating to it.
  Gift Card	The period strictly necessary for the delivery of the Gift Card to the beneficiary and the subsequent use.
  Statistical analysis	The data relating to purchases will be kept - in pseudonymised form - for a period of five years. The other personal data will be kept - in pseudonymised form - for a period of two years.
  Share your wishlist	The period strictly necessary to send the email containing your wishlist

  
  

• TO WHOM DO WE COMMUNICATE YOUR DATA?

  To achieve the processing purposes indicated above, the personal data collected may be disclosed to:
  

  • Calzedonia and Falconeri’s personnel in charge with the management of the services available on the website;
  • Calzedonia and Falconeri’s suppliers and consultants, duly appointed as data processor in compliance with art. 28 of the EU Regulation 2016/679 (hereinafter even only the “Regulation”);
  • Companies that provide payment, shipping and transport services, financial institutions. These subjects act as independent data controllers;
  • Subjects to whom the right to access them is granted by provisions of law or regulations (e.g., public security authorities).

• DO WE TRANSFER YOUR DATA OUTSIDE EU?

  Data collected may be transferred outside the European Union. In this case, the transfer will take place in compliance with the provisions of the Regulation (in particular, Data will be transferred only after signing the Standard Contractual Clauses approved by the EU Commission with decision 2021/914 / EU or to countries able to guarantee an adequate level of protection of personal data and therefore recipients of an Adequacy Decision adopted by the EU Commission).

• WHAT ARE THE RIGHTS THAT YOU MAY EXERCISE AD DATA SUBJECT?

  You can exercise the rights that the Regulation guarantees you regarding your personal data by writing to privacy@oniverse.it.
  We undertake to respond to your request as soon as possible and in any case no later than thirty days from receipt of your report. In some cases, we will ask you for a copy of an identification document if, in connection with your request, it becomes necessary to verify your identity.
  In particular, you can exercise the following rights:

  
  

  • Right of access, i.e., the right to know if a processing of personal data concerning you is in progress and, if confirmed, to obtain a copy of such data and be informed about the origin of the data, the categories of personal data processed, the recipients of the data, the purposes of the processing, the existence of an automated decision-making process (including profiling), the data retention period, the rights provided for by the Regulation;

    Right to request the correction or integration of your data;

    Right to request the deletion of personal data if such data are no longer necessary for the purposes for which they were collected, or if we are no longer authorized to process them;

    Right to obtain the limitation of the processing of personal data in the following cases: i) you have contested the accuracy of the personal data. You can request a processing limitation for the period necessary to verify the accuracy of the data; ii) we are no longer authorized to process the data, and instead of deleting them, you can ask us to limit their use; iii) if the personal data in our possession, despite being no longer necessary for the purposes for which they were collected, are necessary for you to ascertain, exercise or defend a right in court;

    Right to data portability, i.e., the right to receive personal data concerning you in a structured format, commonly used and readable by an automatic device, as well as the right to request that such data be transmitted to another Data Controller;

    Right to revoke the consent, for the processings based on it;

    Right to oppose in qualsiasi momento al trattamento dei tuoi dati personali basato su di un nostro legittimo interesse.

    You also have the right to lodge a complaint with the competent data protection supervisory authority if you believe that the processing of your data conflicts with the provisions of the Regulation.
