PROMOTIONAL INITIATIVE TERMS AND REGULATIONS “FALCONERI CLUB”
Premises

© CALZEDONIA USA, a company subject to management and coordination by Calzedonia Holding S.p.A., with registered offices in Avio (Tn), Viale del Lavoro n. 18, CF and VAT number 02016450229 , makes discounts, benefits and services available to customers in the "Falconeri" stores (direct, as well as participating affiliates) and on the website www.falconeri.com. To benefit from these advantages, you must become a member of the "Falconeri Club": the release of the "Falconeri Club" (hereinafter "Falconeri Club") and its use are governed by the following conditions (hereinafter also "Regulations"), which the "receiving customer" must read carefully. The activation of the "Falconeri Club", in the manner referred to in point 6 below, implies acceptance of these regulations by the Customer. © CALZEDONIA USA reserves the right to periodically modify, even partially, these conditions, and the relative modifications will come into force 10 (ten) consecutive days following their publication on www.falconeri.com. In the event that the "receiving customer" does not accept the changes made, they will have the right to cancel their registration, which remains however, their right at any time as specified below. The use of the Card, after changes have come into force however, implies the acceptance, of the changes made. © CALZEDONIA USA reserves the right to temporarily or permanently, suspend this loyalty program at any time, without the Customer being able to oppose anything (subject only to compliance with the rights already acquired by the participants at that time), by notifying them on the website www.falconeri.com and/or at the points of sale participating in the initiative. These Regulations are always available for consultation at www.falconeri.com/fc-terms-condition.

1. Promoter

2. Participants

All "Falconeri" stores, whether directly managed by © CALZEDONIA USA (so-called "direct stores"), which are affiliated and therefore, managed by other company names (so-called "affiliated shops"), who participate in the initiative. The list of stores participating in the initiative can be viewed on the website www.falconeri.com/falconericlub.

3. Territory

USA national territory.

4. Type / name / purpose of the scheme / duration

This is a promotional initiative consisting of a loyalty programme involving the collection of points on a digital card, the so-called ‘Falconeri Club’ and releasing exclusive benefits to the holders of this card. The purpose of the initiative is to build customer loyalty through a loyalty programme that recognises advantages for customers holding the ‘Falconeri Club’ Card. Without prejudice to what is specified in the premises, in point 7 (’functionality’) and point 10 (’Programme interruption - card deactivation - miscellaneous’), the ‘Falconeri Club’ Card is not subject to expiration

5. Recipients

End customers aged 18 or over, who are members of the "Falconeri Club" according to the registration and operating procedures indicated below.

6. How to enroll to the program

The card to get the “Wool Status” may be released to the Customer in digital format directly at the point of sale, through the website  www.falconeri.com/falconericlub, or by contacting the customer care at 0012058098148. Registration for “Falconeri Club” Card requires the creation of a specific “Falconeri Club” account, which will allow the Customer to access his/her own personal page on the brand's e-commerce website. The registration process will prevent under-age customers from subscribing to the loyalty scheme. The activation and registration procedures are consistent with privacy legislation. The “Falconeri Club” Card is personal and may not be transferred. Customer may not activate other Cards while one Card is still valid. The “Falconeri Club” Card is for private use only and commercial use shall not be permitted. Customers may freely ask at any time to have their membership of the loyalty scheme cancelled by contacting customer care on 0012058098148, or via www.falconeri.com/falconericlub.

7. Method of Operation

"Falconeri Club" will give the customer the opportunity to reach three different STATUSES, by earning points on their purchases. Depending on the status they have reached, the Customer will receive increasing levels of fulfillment. "Wool Status":

  • This level is immediately obtained with the activation/registration of the "new" card;
  • When the "Wool" Customer earns 2000 points over the course of the year, they will reach the next level - "Silk Status" - and any points in excess of those used to reach this status will be credited to the customer;
  • A year after obtaining "Wool Status", and every year thereafter, any Customer who has not earned enough points to move on from Wool Status will remain at the same level and their points balance will be set to zero.

"Silk Status":
  • The Customer obtains this status when they earn 2000 points over the course of one year. Any points in excess of those used to reach this status will be used to reach the next level.
  • When the "Silk" Customer earns 4000 points over the course of one year, they will reach the next level - "Cashmere Status" - and any points in excess of those used to reach this status will be credited to the customer;
  • 2 years after obtaining "Silk Status", and every 2 years, any Customer who has not earned enough points to move up to Cashmere Status:
    -if they have earned at least 1000 points, they maintain their "Silk Status" and any points in excess of those used to maintain this status will be kept;
    -if they have earned less than 1000 points, their points balance will be set to zero and they will go back to "Wool Status".

"Cashmere Status":
  • • The Customer obtains this status when they earn 4000 points over the course of 3 years. Any points in excess of those used to reach this status will be used to reach the next level. 2 years after obtaining "Cashmere Status", and every 2 years after:
    A year after obtaining "Cashmere Status", and every 3 year after:
    -if the Customer has earned at least 1000 points, they maintain their "Cashmere Status" and any points in excess of those used to maintain this status will be kept;
    -if they have earned less than 1000 points, their points balance will be set to zero and they will go back to "Silk Status".

Every change of status, as well as any communication regarding participation in the loyalty program, is strictly necessary for the provision of the related services (such as, for example, confirmation of registration/cancellation, change of status, allocation of specific discounts or reserved gifts) and must be understood as necessary to the operation of the program itself. Therefore, by accepting these regulations, the Customer consents to receiving such communication, which will be sent to the addresses indicated on the program registration form. Refusing to receive such communication will make it impossible for Falconeri S.r.l. to implement the program and to provide the related services. Any refusal expressed during the course of the program will result in its automatic termination.

8. Earning points

Loyalty points will be automatically credited to the activated Falconeri Club account each time a purchase is made in a participating Falconeri store or via the company’s online store (www.falconeri.com). One point will be awarded for every two dollars spent; this amount will be rounded down to the nearest whole number (e.g. $2.99 = 1 point).

8.a Collecting points and Cross Country benefits

Customers holding the Card will also be able to collect points through purchases made within the points of sale in the Countries indicated in the table below. The collection of the aforementioned points, will enable them to be credited and achieve the status and use of prizes provided for in this regulation, in the Italian national territory. The loyalty points will be loaded onto the Customer's Card to the extent of the conversion shown in the table below. Exclusively for purchases made in Russia, loyalty points will be credited upon presentation of the “Falconeri Club” Card.

As a further advantage, Customers in possession of the Card making purchases within the points of sale in the Countries indicated above, are granted discounts reserved by the individual country for the Customer's membership status exclusively at the time of purchase.

9. Benefits

Falconeri Club members can enjoy numerous discounts, promotions, opportunities to win prizes and special initiatives, which will be suitably publicized and communicated from time to time. Specifically, the following discounts are defined as of now:

Upon registration with an e-mail address, customers receive a 15% discount voucher, valid 14 days from the date of issue, without minimum spending (excluding items already subject to discounts or promotions)

For all Statuses:

  • On the occasion of the Customer's birthday, and exclusively in the period between 7 days before and 28 days after the date of the birthday, they will be entitled to receive double points on purchases made (in-stores or on the e-commerce site).


For WOOL Status holders:
  • For every receipt amount of 1000 US Dollars or more, a 10% discount will be immediately applied to the full-price items on the receipt. Items on sale or promotion are therefore excluded (e.g. extraordinary prices).
  • For every receipt amount of 4000 US Dollars or more, a 20% discount will be immediately applied to the full-price items on the receipt. Items on sale or promotion are therefore excluded (e.g. extraordinary prices).
  • Free standard shipping and free returns on online orders


For SILK Status holders:
  • 10% discount on all full-price purchases while the Customer maintains the Status. Items on sale or promotion are therefore excluded (e.g. extraordinary prices).
  • For every receipt amount of 4000 US Dollars or more, a 20% discount will be immediately applied to the full-price items on the receipt. Items on sale or promotion are therefore excluded (e.g. extraordinary prices).
  • Free express shipping and free returns on online orders


For CASHMERE Status holders:
  • 20% discount on all full-price purchases while the Customer maintains the Status. Items on sale or promotion are therefore excluded (e.g. extraordinary prices).
  • Free express shipping and free returns on online orders

10. Program Interruption - Card Deactivation - Various

© CALZEDONIA USA reserves the right to modify, suspend or interrupt the “Falconeri Club” loyalty program and related services at any time and at its own discretion. Specific notice of such changes, suspensions or interruptions will be given by the inclusion of a suitable notice on the website www.falconeri.com and/or in the stores participating in the initiative. Without prejudice to any other right provided for by law, including the right to compensation for damage, © CALZEDONIA USA may revoke the Customer's right to use the Card and deactivate it if the Card is used in violation of the conditions set out in these Regulations, or if is used for fraudulent purposes or damaging use of the image of the "Falconeri" brand. Furthermore, after providing information, © CALZEDONIA USA reserves the right to deactivate the “Falconeri Club” card and its activation/registration, in the event of non-use of the Card or inactivity of the Customer for a period exceeding 5 years. In case of cancellation and/or deactivation, the Customer will no longer be able to use the "Falconeri Club" advantages and services. © CALZEDONIA USA. is not responsible for any consequences, direct or indirect, relating to malfunctions of the loyalty program beyond their control. © CALZEDONIA USA is not responsible for any fraudulent, improper or unlawful use of the Card.

11. Privacy Information

11. Privacy Information Calzedonia Group is very attentive to the privacy and protection of their customers' personal data. We therefore wish to inform you about the ways in which we will process your personal data following registration with the Falconeri Club loyalty program.

What Personal Data will we use?
Your participation in the Falconeri Club loyalty program involves our use of personal data concerning you. To enable your registration with the Falconeri Club loyalty program, we need to process the data you have provided us with at the time of registration, and data relating to purchases made at Falconeri points of sale. In particular, when registering via the web site www.falconeri.com, failure to provide the information marked with an asterisk in the registration form makes it impossible to complete the registration process; for registration made in Falconeri stores, with the assistance of the sales staff, the telephone number or, alternatively, the e-mail address is mandatory data. We may also use other information freely provided by you at the time of registration or relating to the ways in which you interact with us (hereinafter, collectively, "Data"). More precisely, we may collect:

  • optional information requested through the web registration form or, in case of registration made in Falconeri stores with the assistance of the sales staff includes; the name, surname, address, town, postcode, country constitute optional information and the province;
  • information we may obtain by examining your interaction with us, via emails or newsletters, through our internet sites and through the apps which may be developed by us or by third parties (for more information, see the relevant privacy notice);
  • any information you share through social networks you have subscribed to.


For what purposes will we use your Data and on what legal basis?


We will use your data, including by electronic means:
a) to manage your participation in the Falconeri Club loyalty programme. Your Data will be used to enable us to provide you with discounts and other benefits, which may be provided in your favour and, more generally, for all related contractual and administrative obligations
b) so that you can receive a personalized service in all our sales points where the Falconeri Club loyalty program is active. Wherever you are, you can receive help and advice from our sales assistants, with information (e.g. size, colour or model) on items purchased during the previous 24 months at any Falconeri store or even online. Taking into consideration that Falconeri is a global brand, this use of your Data, based on our legitimate interest, allows us to improve the quality of our in-store services and to guarantee a homogeneous service to our customers who have joined the Falconeri Club loyalty program in all our stores. In any case, if you do not wish to receive this assistance, you can merely request that your Data not be used for this purpose at the time of registration or even at a later time.
c) for data analysis activities in aggregate form, in order to obtain information relating to customer purchasing behaviour, the ways in which customers interact with the company through the various communication channels and the effectiveness of commercial initiatives and promotions. This use of your data, based on our legitimate interest, allows us to improve our services and compete with the main operators in the sector. For this purpose, your data will be processed exclusively in pseudonymous form. With your prior consent, we may also use your data for the following purposes:
d) to send you newsletters, information relating to products and services provided by our company, offers and promotions, as well as to conduct market surveys through the contacts provided. We may, for example, send you emails or instant messages (e.g. SMS and WhatsApp), to send you promotional materials via your postal address or contact you by telephone via an operator. Calzedonia Group products are marketed under the following brands: CALZEDONIA, INTIMISSIMI, TEZENIS, FALCONERI and SIGNORVINO.
e) to examine your preferences, the ways in which you interact with us and your purchasing behavior in relation to the Calzedonia Group brands. More precisely, in order to improve our understanding of your tastes and interest in our products and our communications, we will be able to examine - also through the use of automated systems - the information provided at the time of your registration to the Falconeri loyalty program, the purchases made at our points of sale over the last 24 months, your interest in communications and newsletters we will send you, the use of our websites, the methods of use of our Apps and the interest in ours social channels (e.g. Facebook). For more information on the Data that we may acquire by browsing our websites and/or through the use of our Apps, you can consult the relevant privacy policies. Finally, we may complete your profile with statistical information that we can lawfully acquire from other sources: for example, in relation to your area of residence (such as, for example, demographic information, geo-referencing data, etc.) or electronic tools. that you use to interact with us. In any case, this profiling activity is aimed at improving the personalisation of our services and does not entail legal effects or other significant effects for you. Your membership in the Falconeri Club loyalty program is in no way conditioned by the provision of the above consents.

Who will we communicate your data to?
For the purposes of managing the Falconeri Club loyalty program and for administrative purposes, we may communicate your data to our service providers (e.g. IT services) and to the companies that manage the Falconeri points of sale in the various countries where the Falconeri loyalty program Club is active and to other third parties where there is a legal obligation to do so. A complete list of these companies will be made available by sending a written request to the contacts indicated below.

How will the transfer of your data to non-EU countries be regulated?
Your data may be transferred outside the European Union territory, even in countries where the level of protection of personal data may be lower than that guaranteed by European legislation. In any case, this transfer will take place in compliance with adequate guarantees for the protection of your data and in particular, with the standard contractual clauses approved by the EU Commission with decision no. 2010/87/EC.

What rights can you exercise?
You have the right to request access to rectification or cancellation of the Data, limitation of processing and to object its use by us, as well as the right to request the delivery of some of these.

Right of access
The interested party has the right to obtain confirmation from the data controller as to whether or not personal data concerning them is being processed and in this case, to obtain access to personal data and the following information:

  • the purposes of the processing;
  • the categories of personal data in question;
  • the recipients or categories of recipients to whom the personal data has been or will be disclosed, in particular if recipients of third countries or international organisations and, in this case, the existence of adequate guarantees;
  • when possible, the retention period of personal data provided or if not possible, the criteria used to determine this period; ;
  • the existence of the subject's right to ask the data controller to rectify or delete personal data or limit the processing of personal data concerning them or to oppose their processing;
  • the right to submit a complaint with the supervisory authority;
  • if the data is not collected from the data subject, all available information on their origin;
  • the existence of an automated decision-making process, including profiling, which produces legal effects concerning them or which significantly affects the person and at least in such cases, significant information on the logic used, as well as the importance and expected consequences of such processing for the data subject.


Right of rectification
The interested party has the right to obtain the correction of inaccurate personal data concerning them without undue delay, from the data controller. :




Right of erasure
The data subject has the right to obtain from the data controller, the cancellation of personal data concerning them without undue delay and the data controller is obliged to cancel the personal data without undue delay, if one of the following reasons exists:


  • the personal data is no longer required for the purposes for which they were collected or otherwise processed;
  • the interested party revokes the consent on which the processing is based and there is no other legal basis for the processing;
  • the interested party opposes the processing, and there is no legitimate overriding reason to proceed with the processing;
  • the personal data have been unlawfully processed;
  • Personal data must be deleted to fulfill a legal obligation under European Union law or the law of the Member State to which the data controller is subject;


Right of restriction of processing
The interested party has the right to obtain from the data controller the limitation of processing under one of the following assumptions:



Right of opposition
The interested party has the right to object to the processing of personal data concerning them based on the legitimate interest of the owner, including profiling, at any time. Furthermore, the interested party has the right to object to the processing of personal data concerning them for direct marketing purposes, including profiling, to the extent that it is connected to such direct marketing, at any time.




Right of data portability
The interested party has the right to receive commonly used and readable by an automatic device, personal data concerning them provided to a data controller in a structured format and has the right to transmit such data to another data controller without impediments from part of the data controller to whom they provided them if:

  • the processing is based on consent or on a contract and
  • the processing is carried out by automated means.

  • In exercising their rights relating to data portability, the interested party has the right to obtain the direct transmission of personal data from one data controller to the other, if technically feasible.



How can you change your preferences or withdraw consent?
At any time, you can check, modify or revoke your consent in relation to the purposes referred to in letters (d) and (e) (even declaring that you do not wish to receive commercial information via email and/or instant messaging) and/or request that your Data is not used for the purpose referred to in letter (b).
For those registered through the website www.falconeri.com these operations will be possible:


  • through the account used for registration, in the section dedicated to your privacy preferences;
